In the bustling heart of Mumbai's Chembur area, a significant legal battle unfolded between applicant  and an Enterprises, shedding light on the often murky waters of real estate transactions. In 2011, applicant  and his wife embarked on the journey of purchasing their dream home at Tilak Nagar, Chembur. The couple paid a substantial sum of Rs. 28,00,000 as an initial deposit, with the total consideration amounting to Rs. 62,00,000. However, despite their timely payments, the Enterprises and associates – failed to commence construction or obtain the necessary permissions for the project between 2011 and 2017.

As the years rolled by with no progress, the Singh family grew understandably anxious. In an attempt to address the growing discontent, the developers proposed an alternative flat at Tilak Nagar, Chembur. However, this offer came with a catch – the consideration amount was now a steep Rs. 81,27,000, a unilateral decision that left the plaintiffs feeling deceived and compelled them to seek legal redress.

In a move that provided immediate relief, the court also directed the enterprises to deposit Rs. 28,00,000 – the amount already paid by the plaintiffs – into the court. This decision not only secured the plaintiffs' financial interests but also sent a clear message about the judiciary's stance on protecting buyers from unscrupulous practices in the real estate sector.
